By virtue of a certified copy of a decree to me directed from the Clerk of the Superior Court of Fulton County, Indiana, in Cause No. 25D01-1208-MF-631, wherein MetLife Home Loans, a division of MetLife Bank, N.A. was Plaintiff, and Jerry C. Martin, Kelly F. Martin and Occupant(s) of 9222 State Road 25, Rochester, IN 46975, were the Defendants, requiring me to make the sum as provided for in said Decree with interest and costs, I will expose at public sale to the highest bidder, on the 23rd day of July, 2013 at 10:00 A.M. of said day, at 200 E 8th Street, Rochester, IN 46975, the fee simple of the whole body of Real Estate in Fulton County, Indiana:
The following described real estate situate in Fulton County, State of Indiana: A tract of land in Section 42, Michigan Road Land, in Fulton County, Indiana: Beginning 42 feet North 25 degrees 12 minutes East of the Southeast corner of the North half of the Northwest Quarter of Section 42 which beginning point is on the West right of way line of the Michigan Road, thence North 25 degrees 12 minutes East along the right of way 98 feet which is to a ten inch square cement post; thence North 74 degrees 48 minutes West 360 feet; thence South 56 degrees 12 minutes West 93 feet; thence South 17 degrees 12 minutes West 74 feet which is to a fence; thence South 79 degrees 48 minutes East along the fence 95 feet; thence South 70 degrees 48 minutes East 130 feet; thence North 18 degrees 12 minutes East 58 feet which is along a fence; and thence South 71 degrees 48 minutes East which is along a fence 180 feet which is to Michigan Road right of way and the place of beginning, containing 1.126 acres. Subject to all easements and restrictions of record not otherwise extinguished in the proceedings known as Cause # 25D01-1208-MF-631 in the Superior Court of the County of Fulton Indiana, and subject to all real estate taxes, and assessments currently due, delinquent or which are to become a lien.
Said sale will be made without relief from valuation or appraisement laws. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, or the Mortgagee's Attorney.
